Judge Releases Bireete on Bail, Citing Constitutional Safeguards
Following a month-long detention, a Ugandan court has granted Sarah Bireete, the Executive Director of the Centre for Constitutional Governance, cash bail of Shs1 million. In reaching its decision, the court cited constitutional protections, the extended duration of detention, and the principle of proportionality.
As part of the ruling, the judge ordered Bireete to deposit her passport and restricted her from traveling outside Uganda unless she first obtains court approval. In doing so, the court sought to ensure accountability while safeguarding her rights.
Court Imposes Strict Bail Conditions
In addition to granting bail, the court set strict reporting requirements to guarantee Bireete’s continued compliance. According to judicial officers, these conditions aim to secure her appearance in court as investigations proceed.
At the same time, the judge stressed that courts must balance individual liberties with state interests, particularly when cases involve public data and national institutions.
Authorities Arrested Bireete Over Voters’ Data Allegations
Earlier last month, security agencies arrested Bireete over allegations that she unlawfully accessed voters’ data belonging to the Electoral Commission. According to prosecutors, the alleged access occurred during previous research activities.
As a result, the case has triggered debate over the boundary between data protection enforcement and legitimate civic research.
Prosecution Defends Charges as Investigations Continue
Meanwhile, state prosecutors informed the court that investigations remain ongoing and confirmed that they will present additional evidence during future hearings.
Furthermore, prosecutors argued that data protection laws apply equally to all individuals and organizations, regardless of institutional affiliation or public interest claims. In their view, consistent enforcement strengthens public trust.
Defense Says Charges Criminalize Legitimate Research
In response, Bireete’s lawyers challenged the charges, arguing that the state is criminalizing lawful research and civic engagement protected under the Constitution.
Moreover, the defense emphasized that electoral research promotes transparency, accountability, and democratic reform. Consequently, they warned that prosecutions of this nature could discourage public-interest research.
Civil Society Groups Express Concern
Simultaneously, civil society organizations welcomed the bail decision while raising alarm over what they described as a shrinking civic space.
Additionally, activists warned that increased legal pressure on researchers and governance watchdogs could weaken democratic oversight. For this reason, several advocacy groups called for clearer legal guidelines on access to public data.
Court Sets Mention Date as Case Proceeds
Looking ahead, the court has scheduled a mention date to review compliance with the bail conditions and assess the progress of investigations.
Ultimately, legal analysts say the case could shape future enforcement of data protection laws in Uganda and influence how authorities regulate civic and research-based access to public information.
